“Transporting Prohibited Items: The Red Line of the Law Must Not Be Crossed”

In the logistics and transportation industry, there are certain “minefields” that must never be touched, namely the transportation of prohibited items. Prohibited items refer to goods that are not allowed to be privately manufactured, purchased, used, possessed, stored, transported, imported, or exported as stipulated by law. Different modes of transportation, such as air, rail, road, and sea transport, each have their own detailed and strict lists of prohibited items.​

Take air transportation as an example. Firearms and police equipment, including various military and civilian firearms, sporting guns, hunting rifles, and even realistic toy guns, are strictly prohibited from being transported. This is because firearms are extremely dangerous. Once an accident occurs during transportation and they fall into the hands of criminals, it will pose an immeasurable threat to public safety. Ammunition and explosive items are also absolutely prohibited. Bombs, grenades, bullets, explosives, etc., if these items explode due to factors such as vibration and friction during transportation, the consequences will be unimaginable.​

In rail transportation, the items prohibited for passengers to carry or check in are also very diverse. In addition to firearms, ammunition, explosive items, and their imitations, flammable and explosive items, such as compressed and liquefied gases like hydrogen and methane, flammable liquids like gasoline and kerosene, as well as poisonous substances, corrosive substances, and radioactive substances, are all on the prohibited list. For example, in November 2020, Ma Hai Moumou in Xide County, Liangshan Prefecture, was caught on the spot for attempting to board a train at the railway station with 7050 milliliters of gasoline and was ultimately given an administrative detention of ten days. This case fully demonstrates the strict control of prohibited items in rail transportation.​

In road transportation, there are also many restrictions on prohibited items. Not only are various hazardous chemicals strictly prohibited from being transported, but also items that may endanger the public health or operational safety of road passenger vehicles, such as substances with a strong pungent odor like hydrogen sulfide, and items that are likely to cause panic among passengers, are not allowed to be transported.​

Sea transport is no exception. Customs has strict supervision over imported and exported items. Items prohibited from entering the country include weapons, imitation weapons, ammunition, counterfeit currency and securities, printed matter and audio – visual products harmful to China’s politics, economy, culture, and morality. Items prohibited from leaving the country include some of the items prohibited from entering, as well as precious cultural relics, endangered animals and plants and their products. These regulations aim to safeguard national security, social stability, and ecological balance.​

Transporting prohibited items not only poses a huge threat to the safety of personnel and property during transportation but also seriously violates laws and regulations. Once detected, transportation enterprises or individuals will face severe penalties, including fines, revocation of business licenses, and even criminal liability. Therefore, both transportation enterprises and practitioners must clearly understand the scope of various prohibited items, strictly abide by transportation regulations, and never cross the red line of the law for the sake of short – term interests.
