Austria adheres to EU TPD regulations, overseen by the Federal Ministry of Social Affairs, Health, Care and Consumer Protection. E-cigarettes containing nicotine are legal but subject to strict controls to ensure consumer safety.​

Key requirements include e-liquid nicotine concentration capped at 20mg/ml and tank capacity limited to 2ml. Labels must be in German, featuring warnings such as “Nikotin ist Sucht erregend” (Nicotine is addictive) and a comprehensive list of ingredients. All products must bear CE marking to confirm compliance with EU safety standards.​

When transporting e-cigarettes to Austria, lithium batteries must comply with ADR regulations for road transport and IATA guidelines for air freight. Each package containing batteries must be clearly labeled with “Lithium-Ionen-Batterien” (Lithium Ion Batteries) and the UN number 3480. Additionally, a safety data sheet in German detailing battery specifications and handling procedures is mandatory.​

Customs clearance requires a detailed commercial invoice, an EORI number, and a certificate confirming compliance with TPD. Austria imposes a 20% VAT on e-cigarettes, along with a tobacco tax of €0.10 per ml of nicotine-containing e-liquid. The Austrian Agency for Health and Food Safety (AGES) may conduct random inspections, so it’s crucial to retain batch test reports and compliance certificates.
