The Netherlands adheres to EU TPD regulations, with oversight from the Food and Consumer Product Safety Authority (NVWA). E-cigarettes containing nicotine are legal but subject to comprehensive controls to ensure safety and prevent youth access.​

Key requirements include a maximum nicotine concentration of 20mg/ml in e-liquids and a 2ml limit on tank capacity. Labels must be in Dutch, featuring clear warnings such as “Nicotine is verslavend” (Nicotine is addictive) and a full list of ingredients. All products must carry CE marking and be packaged in child-resistant containers to prevent accidental access by children.​

When transporting e-cigarettes to the Netherlands, lithium batteries must comply with ADR regulations for road transport and IATA guidelines for air freight. Each package must be labeled “Lithium-ion batterijen” (Lithium Ion Batteries) along with the UN number 3480. A safety data sheet in Dutch, detailing battery specifications and handling procedures, is also mandatory.​

Customs clearance requires a detailed commercial invoice, an EORI number, and a certificate confirming compliance with TPD. The Netherlands imposes a 21% VAT on e-cigarettes, plus a tobacco tax of €0.08 per ml of nicotine-containing e-liquid. The NVWA may conduct post-import inspections, so retaining batch test reports and compliance certificates is essential.
