I. China’s drone export supervision system
Core regulatory basis
“Export Control Law of the People’s Republic of China” (implemented in December 2020)
“Administrative Measures for the Import and Export License of Dual-Use Items and Technologies” (Ministry of Commerce Order No. 29 of 2005)
Ministry of Commerce Announces New Temporary Export Control Measures for Drones in 2023 (Effective from July 2023)
Regulatory departments
Ministry of Commerce (responsible for export license approval)
General Administration of Customs (actual export supervision)
State Administration of Science, Technology and Industry for National Defense (military technology conversion review)
II. Civilian drone models that can be freely exported (no special license required)
Type Typical parameter range Representative model case Main purpose
Consumer-grade aerial photography drone Endurance <30 minutes, speed <50km/h DJI Mini 4 Pro, Air 3 Photography, agricultural surveying
Light industrial drone Take-off weight <4kg, no throwing function XAG P40 agricultural drone Pesticide spraying, terrain survey
Logistics test drones with a load of <1.2kg, operated within visual range SF DRONE Falcon Short-distance medical supplies transportation
Key restrictions:
All military modification interfaces must be closed (such as weapon mounting, military encrypted communication modules)
The maximum range must be locked within 300km (according to the new regulations in 2023)
Real-time positioning accuracy must not be better than 0.5 meters (in line with the requirements of the international missile technology control regime MTCR)
III. Models that require export licenses
Control technology list:
Endurance ≥1 hour (such as the CW-15 vertical take-off and landing drone)
Can carry ≥5kg payload (such as the AVIC AR-500 ship-borne drone)
With beyond visual range (BVLOS) or cluster control function
Special approval process:
Chart
Code
IV. Key embargoed models (updated in 2024 )
Absolutely prohibited from export:
Attack drones (such as Wing Loong-2, Rainbow-5)
Any model that can carry a catapult/drop device
Anti-interference navigation system (Beidou III military-grade module)
Gray area products:
Industry drones with “one-click ADS-B shielding” function
Flight control systems compatible with satellite communication modules such as Starlink
V. Corporate compliance recommendations
Risk self-check list:
Check whether the flight control system has a backdoor programming interface
Confirm that the maximum level flight speed is ≤278km/h (MTCR red line)
Delete all geo-fence bypass function codes
Latest developments:
From April 2024, the EU began to require imported Chinese drones to provide an “End-User Certificate”. It is recommended to prepare dual certification documents (CCPIT + CCPIT certification) in advance.
